The first step is to agree to get divorced and then file a petition for divorce in court. Then you will have to decide how to settle the divorce with your spouse. For example, you must agree on the division of assets and debts, allocation of child custody, child support, alimony, and whether the spouse will restore her maiden name.
Your spouse will have to file a response agreeing to all the requests you made in the divorce petition. In some states, divorcing couples must attend a final hearing in court, where they answer a few questions under oath. The judge will then sign the divorce papers and request you wait about one to six months for the divorce to be finalized.
